Terms of Service

The agreement between you and AskWebbie LLC for our website, hosting, domain and email services.

1. About these terms

These Terms of Service (the "Terms") are a binding agreement between you and AskWebbie LLC, a Missouri limited liability company ("Ask Webbie," "we," "us" or "our"). They cover your use of askwebbie.com, your Ask Webbie account, and every service we provide to you (together, the "Service").

"You" means the person who accepts these Terms. If you sign up for a business, it also means that business. By accepting, you confirm that you have the authority to bind that business to these Terms.

You accept these Terms when you check the agreement box on our Join page, create an account, pay for a plan, or use the Service. If you don't agree, please don't use the Service. You must be at least 18 years old to create an account. The Service is offered for business and professional use.

Our Privacy Policy explains how we handle personal information, and it is part of these Terms.

2. What Ask Webbie provides

Depending on your plan and the add-ons you choose, the Service includes:

  • A custom website designed for your business, built to work on desktop and mobile, and hosted by us.
  • Updates through Webbie, our AI assistant in your account, and through requests to our team.
  • Domain registration if you don't already have a domain (see Domain names), or connecting the domain you already own.
  • Custom email addresses on your domain, as a paid add-on.
  • Contact forms on your website that send visitors' messages to you by email.

We may also offer a free design preview before you join. A preview carries no obligation, and we may remove it if you don't join.

The features, timelines and examples on our website describe the Service in general terms. They aren't a promise of a specific design, delivery date or result.

3. Your account

  • Give us accurate, complete information, and keep it up to date. This includes your contact details and your business details.
  • Keep your password private. You're responsible for everything that happens in your account.
  • Tell us right away at start@askwebbie.com if you think someone has used your account without permission.
  • Our team can view your account and website to build, support and maintain them. With your permission, we may also act in your account on your behalf, for example to make a change you asked for.

4. Plans, billing and automatic renewal

Price. The Ask Webbie Website plan is $29 per month. Custom email addresses are an add-on and start at $5 per address per month. Prices are in US dollars, and the same plan is available worldwide. Current prices are always on our Pricing page and in your account. We don't charge startup fees or design fees.

Automatic renewal. Your subscription starts when you pay. It renews automatically every month, on the same day of the month (or the last day of a shorter month), until you cancel. By subscribing, you authorize us (through our payment processor, Stripe) to charge your payment method each month for your plan and add-ons, plus any applicable taxes. You can cancel at any time (see Cancelling). After you subscribe, we email you a confirmation with your price, these renewal terms and how to cancel.

  • Payment. Stripe processes all payments. We never see or store your full card number. You can update your card on the Billing page in your account.
  • Taxes and currency. Prices don't include sales tax, VAT or similar taxes. Where they apply, we'll add them. If your card is in another currency, your bank converts the charge and may add its own fee.
  • Design review (optional). You can add a one-time design review for $99 when you join or later from your account. A person from our design team goes over your website with you and customizes its design. It's charged once (with your first payment if you add it when you join, or to your card on file when you buy it later). It isn't part of your monthly plan and never renews. Your custom design is still free with your plan without it.
  • Adding or removing email addresses. Changes to add-ons take effect right away. Your monthly charge is adjusted, with a prorated charge or credit for the rest of the current month on your next invoice.
  • Price changes. If we change the price of your plan or add-ons, we'll email you at least 30 days in advance. The new price applies from your next billing date after those 30 days. If you don't want to pay the new price, you can cancel before it takes effect.
  • Promotions. Discounts and promotion codes apply only as described when they're offered. Unless we say otherwise, they can't be combined and have no cash value.
  • Failed payments. If a payment fails, we'll retry it and let you know. If your account is still unpaid 14 days after the due date, we may suspend your website and email until you pay. If it's still unpaid after 30 days, we may cancel your subscription. In that case, the steps in What happens after your plan ends apply.
  • Disputes. If you think a charge is wrong, email us first and we'll work it out quickly. Filing a chargeback without contacting us may result in your account being suspended while the dispute is open.

5. Cancelling, and what happens after

How to cancel. You can cancel anytime. Use Cancel plan on the Billing page in your account, or email start@askwebbie.com from the email address on your account. There are no cancellation fees and no long-term contracts.

When it takes effect. Cancellation takes effect at the end of your current paid month. Until then, your website, email and account keep working, and you can change your mind.

Refunds. We don't give refunds or credits for partial months or unused time, except the prorated adjustments for add-on changes described above, or where the law requires it. If we charged you in error, we'll refund that charge.

What happens after your plan ends

  • Your website goes offline. Your askwebbie.com hosted address, and any domain we registered for you, automatically redirect to askwebbie.com. A domain you own at another registrar is not redirected (see Domain names).
  • Custom email addresses are closed and their mailboxes deleted. Please download or forward anything you want to keep before your plan ends.
  • Your content. Within 30 days after your plan ends, you can ask us for a copy of the content you gave us, such as your text, photos, logo and files. We'll send it to you.
  • Coming back. We keep a copy of your website and account for at least 30 days. If you rejoin within that time, we can usually restore your site as it was. After that, we may delete it.
  • Your domain. See If you cancel: your domain.

6. Domain names

If you already own a domain

Your domain stays yours, at your current registrar. To put your Ask Webbie website on it, you either give us access to manage it (for example, through your registrar's delegate or account access feature) or point its DNS settings where we tell you. You're responsible for keeping that domain registered and renewed with your registrar unless we agree otherwise in writing.

We'll only change your domain's settings as needed to provide the Service, such as pointing it at your website or setting up email. When your plan ends, we'll stop using our access. You can then remove our access and point the domain wherever you like. We won't redirect a domain that we didn't register for you.

If we register a domain for you

  • Included with your plan. If you don't have a domain, we register one for you at no extra charge. You choose from standard, non-premium names that we offer and that are available. We pay the yearly renewal for as long as your subscription is active and paid.
  • Registered through Namecheap. We aren't a domain registrar. We register domains through Namecheap, Inc., an ICANN-accredited registrar. The registration is also subject to the Namecheap Registration Agreement, the registry's rules for that domain extension, and ICANN policies, including the Registrants' Benefits and Responsibilities. We follow those terms as the registrant, and you agree to follow them while the domain is used for your website.
  • We own it. We buy the domain and take ownership of it. AskWebbie LLC is the registrant, using our own contact details, and the domain stays in our registrar account. You don't need to give us an address or phone number for it. Using the domain for your website doesn't make you its owner, but you can ask us to release it to you at any time (see If you cancel: your domain).
  • Managing it. We manage the domain's settings (DNS, renewal and privacy protection) while it's in our account, and we use it for your website for as long as your plan is active. After your plan ends, we may redirect it as described below.
  • Choosing a name. You're responsible for making sure the name you choose doesn't infringe anyone's trademark or other rights. Domain disputes are handled under ICANN's Uniform Domain-Name Dispute-Resolution Policy and the registrar's terms.

If you cancel: your domain

  • Redirect. After your paid period ends, we may point a domain we registered for you to askwebbie.com. It stays that way until the domain is released to you or expires. We won't sell it, give it to anyone else (other than to you, if you ask), or use it for anything other than this redirect.
  • Release to you. The domain is ours, but if you want it, we're happy to release it to you. At any time, during your subscription or after you cancel, as long as the domain hasn't expired, email start@askwebbie.com and tell us which registrar you want it moved to. We'll transfer it to you there, or move it into a Namecheap account in your name if you prefer. Once it's released, you own it.
  • Release fee. The release is free if you've made at least 3 monthly payments for Ask Webbie (payments that were refunded or charged back don't count). If you've made fewer than 3, the release costs a one-time fee of $49, which covers the registration we paid for. It's payable when you ask for the release.
  • Timing. We'll start the release within 5 business days after we receive your request (and the fee, if one applies). We'll send you the authorization code or account details your new registrar needs.
    • Under registry rules, a domain can't move to a different registrar for 60 days after it's registered (or after its owner details change). During that time, we can move it into your own Namecheap account instead, or transfer it once the 60 days are up.
    • Your new registrar may charge its own transfer fee, which usually adds a year of registration.
  • Renewal after you cancel. We pay renewals only while your subscription is active. After your plan ends, we keep the domain until its current registration period runs out. We aren't required to renew it after that. We'll try to remind you before it expires, but if it hasn't been released to you by its expiration date, it may expire and become available for anyone to register.

7. Who owns what

Your content stays yours. "Your content" means everything you or your business provide: text, photos, logos, files, product and business information, and anything we copy at your request from your existing website, social media or online shop pages. You keep all your rights to it.

You give us a non-exclusive, worldwide, royalty-free license to use, copy, store, edit, resize, format, publish and display your content, only as needed to build, host, improve and support your website and provide the Service. This license ends when your content is removed from the Service. Copies may remain for a short time in backups, and in examples you've allowed us to show (see Portfolio below).

You confirm that you have the rights to your content. This includes photos, logos, reviews and text. You also confirm that our use of it as described here won't violate anyone's rights or the law. When you ask us to pull images or information from a website or account, you confirm that it belongs to you or your business, or that you have permission to use it.

Our materials stay ours. AskWebbie LLC keeps all rights to our software, including Webbie, and to our templates, layouts, designs, code, graphics we create or license, and the Ask Webbie name and logo. While your subscription is active, we give you a limited, non-transferable license to use your website, as we host it, for your business. Your website is a service we provide, not a product we sell, and we don't hand over its design or code. When your plan ends, this license ends and the site goes offline as described in Cancelling.

Logos we design for you. If we design a logo specifically for your business and you use it on your website, it's yours to keep and use anywhere once you've made at least 3 monthly payments. We'll send you the files on request.

Images we provide. Stock or AI-generated images we add to your site are licensed for use on your Ask Webbie website only.

Portfolio. We may show your website, such as a link, screenshots and your business name, as an example of our work. To opt out, email us.

Credit link. Your website may include a small "Website by Ask Webbie" link in the footer.

Feedback. If you send us ideas or suggestions, we may use them without any obligation to you.

8. Webbie, our AI assistant

  • How it works. Webbie uses artificial intelligence (currently provided by Anthropic) to build and update websites from your requests, files and the public information you point us to. Our team may also use AI tools to research your business and draft your site.
  • It can make mistakes. Webbie may misunderstand a request or produce wording, prices, hours or other details that are wrong. Your changes appear in a preview first, and nothing goes live until you press Publish. Please check the preview carefully. You're responsible for the content you publish.
  • Monthly edits. Your plan includes a monthly amount of Webbie edits. Your account shows how much of it you've used. Small changes use a little and large ones (like a full redesign) use more. Your edits reset when your next monthly payment goes through.
  • Extra edits. If you run out, you can add more for the rest of that month: $9 or $19 (the larger one adds about twice as much). Extra edits are charged to your card on file when you add them, are non-refundable once used, and don't carry over to the next month.
  • Fair use. We may limit unusually heavy use that affects the Service for others. You can also ask our team for changes; we handle those within reasonable limits and may quote larger projects, such as a full redesign, separately.
  • Limits. Webbie and our team may decline a request that breaks these Terms, the law, or technical limits of the Service.

9. Custom email addresses

Custom email addresses on your domain are provided through our hosting provider and billed per address per month. Each mailbox comes with storage and sending limits set by that provider. You're responsible for how your mailboxes are used, and for keeping copies of important messages.

Sending spam, phishing or bulk unsolicited email is not allowed, and may get your email suspended right away. When an address is removed, or your plan ends, its mailbox and messages are deleted.

10. Acceptable use

You may not use the Service, or ask us to publish anything, that:

  • breaks any law or regulation, or promotes illegal activity, illegal goods or illegal services;
  • infringes anyone's copyright, trademark, privacy, publicity or other rights;
  • is fraudulent, deceptive or misleading. This includes fake reviews, false claims about your products or services, and impersonating anyone;
  • contains sexually explicit material, or content that exploits or harms minors;
  • harasses, threatens or promotes violence or hatred against any person or group;
  • contains malware or phishing, or tries to collect sensitive information under false pretenses;
  • sends spam, or uses our forms or email for bulk unsolicited messages;
  • tries to get into accounts, systems or data you aren't allowed to access, or to disrupt, overload, probe or reverse-engineer the Service;
  • resells the Service, or uses it to provide website services to others, without our written permission.

If you sell regulated products or services (for example, alcohol, firearms, financial, legal or health services), you're responsible for meeting the rules that apply to your website and advertising.

We may remove content, refuse a request, or suspend the Service if we reasonably believe these rules have been broken.

11. Your responsibilities for your website

  • Accuracy. Check that your website's content is accurate and up to date: prices, hours, services, licenses and claims.
  • Your own legal pages. Your website is your business's website. You're responsible for any legal notices your business needs, such as a privacy policy for your visitors, terms of sale and required disclosures. We can add these to your site from text you provide.
  • Visitor messages. When visitors use your website's contact forms, we process their messages for you and deliver them to the email address you choose. You're responsible for how you use those messages and for replying to them lawfully.
  • Accessibility and compliance. We follow good practices for accessible, mobile-friendly websites. We can't guarantee, however, that your website meets every law or standard that applies to your business.

12. Third-party services

The Service relies on other companies, including Stripe (payments), Hostinger (hosting and email), Namecheap (domain registration), Anthropic (AI) and Google (web fonts). It may also connect to services you point us to, such as Etsy or Facebook.

Their own terms may also apply. We aren't responsible for their services, outages or decisions, but we'll work with them to keep your website running. Links to other websites are provided for convenience; we don't control those sites.

13. Availability, backups and support

  • We work to keep your website online and fast, but we don't guarantee uninterrupted or error-free service. Planned maintenance, provider outages and events outside our control can cause downtime.
  • We keep previous published versions of your website (currently the last 30) so changes can be undone. Please keep your own copies of important content and files.
  • Support is available by email at start@askwebbie.com and from the Help page in your account. We usually reply within one business day.

14. Copyright complaints

If you believe content on a website we host infringes your copyright, send a notice to start@askwebbie.com. Include:

  • your contact details;
  • a description of the copyrighted work;
  • the web address of the material you're complaining about;
  • a statement that you have a good-faith belief the use isn't authorized;
  • a statement, under penalty of perjury, that your notice is accurate and that you're the owner or authorized to act for the owner;
  • your physical or electronic signature.

We'll respond as required by the Digital Millennium Copyright Act. We may remove the material and, where appropriate, end the accounts of repeat infringers.

15. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement.

We don't promise that your website will reach any search ranking, amount of traffic, number of leads or level of sales. We also don't promise that AI-generated content will be accurate or complete.

16. Limitation of liability

To the fullest extent allowed by law, neither AskWebbie LLC nor its owners, employees or providers will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, goodwill or business opportunities, arising from or related to the Service or these Terms, even if we were told such damages were possible.

Our total liability for all claims arising from or related to the Service or these Terms is limited to the amount you paid us for the Service in the 12 months before the event that gave rise to the claim.

Some places don't allow certain of these limits. In those places, they apply to the extent allowed.

17. Indemnification

You agree to defend, indemnify and hold harmless AskWebbie LLC, its owners and employees from any claims, damages, losses and costs (including reasonable attorneys' fees) arising from:

  • your content;
  • your business, products or services;
  • the domain name you chose;
  • your breach of these Terms;
  • your violation of any law or anyone else's rights.

18. Suspension and termination by us

We may suspend or end your access to the Service if:

  • you seriously or repeatedly break these Terms;
  • your account is unpaid as described in Billing;
  • the law requires it;
  • your use creates a risk or legal exposure for us or others.

Where it's reasonable, we'll tell you first and give you a chance to fix the problem.

We may also stop offering the Service, or end your subscription for any other reason, by giving you at least 30 days' notice. If we do that, without any fault on your part:

  • we'll refund any prepaid fees for time after the end date;
  • we'll release any domain we registered for you to you, free of charge.

Sections that by their nature should survive the end of these Terms will survive. This includes the sections on ownership, domain names, disclaimers, limitation of liability, indemnification and disputes.

19. Changes to the service and these Terms

We're always improving Ask Webbie, so features may change. If we make a material change to these Terms, we'll tell you by email or in your account at least 30 days before it takes effect. If you keep using the Service after that, you accept the new Terms. If you don't agree, you can cancel before the change takes effect.

The "Last updated" date at the top shows when these Terms last changed. You can ask us for an earlier version at any time.

20. Governing law and disputes

These Terms are governed by the laws of the State of Missouri, USA, without regard to its conflict-of-laws rules.

Before filing a claim, please email start@askwebbie.com and give us 30 days to try to resolve it informally. Most problems can be solved this way.

If we can't resolve a dispute, it will be decided exclusively in the state or federal courts located in the State of Missouri, and you and we agree to those courts' jurisdiction. Either of us may instead bring a qualifying claim in small claims court.

21. General terms

  • Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
  • Electronic communications. You agree to receive notices, receipts and agreements electronically. We'll send them to the email address on your account. Notices to us go to start@askwebbie.com.
  • Severability. If any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver. If we don't enforce a right, we haven't waived it.
  • Assignment. You may not transfer your account or these Terms without our written consent. We may transfer them as part of a merger, acquisition or sale of our business, and we'll tell you if we do.
  • Events outside our control. We aren't responsible for delays or failures caused by events beyond our reasonable control, such as outages at our providers, natural disasters or internet failures.
  • Relationship. We're independent contractors. Nothing in these Terms creates a partnership, employment or agency relationship, except that you authorize us to act for you as described in Domain names.
